Puppy contract
CONTRACT OF SALE
This document constitutes a contract of sale entered into on the ____day of __________ between Pam Matthews (herein referred to as Seller) and _____________________(referred to as Buyer(s) for the purposes of setting for the terms and conditions of the purchase of a Golden Doodle puppy known as __________________ Purchase price of _______cash____paypal______.
CONDITIONS OF SALE:
___1. Seller warranties that above dog is to the best of my knowledge in good health at the time of transfer of ownership.
___ 2. Seller to send/deliver/allow pick up when payment is guaranteed.
___ 3. Seller guarantees that the above dog is to be free from severe hip dysplasia determined at 2 years of age and not before or after 2 years of age, by x-ray and evaluation of the Orthopedic Foundation for Animals (OFA). All x-rays must be done by an experienced veterinarian. We reserve the right to examine x-rays and have our veterinarian approve them. This does not include hip deformation or abnormalities caused by injury, poor quality food, over exercise and jumping during their growth period (1 1/2 years), due to being overweight, has not been overfed for its height/structure, or malnutrition.
___ 4. If the dog is found to be dysplastic, the Buyer(s) must notify the Seller immediately and provide appropriate documentation from OFA of defect. Dogs with a rating of Excellent, Good, Fair, and Borderline are not considered dysplastic. After these qualifications are met the seller will at the seller's sole descretion provide a replacement puppy, with the return of said puppy, or refund up to half the purchase price of the puppy.
___ 5. Buyer agrees to spay or neuter by the age of 4, but no later than 6 months of age. Puppy/dog is not bought for the purpose of breeding.
___ 6. Buyer(s) agrees to have puppy examined by a veterinarian within the first 3 days, or said warrantee is null and void. Buyer agrees to notify Seller of any health problem immediately after exam. If puppy is found to be seriously ill then puppy of equal or greater value will be given at the discretion of the Seller according to availability. A signed written letter from examining vetrinarian must be provided as proof of illness to the Seller.
___ 7. Buyer(s) agrees to feed a dog food of good quality, complete puppy shots, give yearly vaccinations and heart worm medication along with a SECURE area for exercise.
___ 9. This is only applicable for puppies bought for the purpose of a therapy dog. Buyer(s) agrees to buy this dog for the purpose of a therapy dog. To be professionally and properly trained to be such. Buyer(s) agrees to notify Seller immediately if dog is found to be unable to perform therapy duties for any reason.
___ 10. This is only applicable for puppies bought for the purpose of a therapy dog. Buyer(s) agrees to notify Seller immediately. If Buyer(s) decides for any other reason not to use this dog for the purpose of a therapy dog. Buyer(s) agrees to give full price of _____ for the dog to the Seller due immediately.
___ 11. BUYER AGREES THAT THE PUPPY IS NOT FOR RESALE. If for any reason buyer is unhappy with puppy or can not keep the puppy, buyer agrees to notify seller and to return puppy to the seller at the sellers discretion. If for any reason the buyer is unable to keep said puppy/dog at any time in the future, seller agrees to help rehome the dog. Buyer agrees to never surrender said puppy/dog to a shelter.
___ 12. Any disputed claim regarding the limited warranty for this puppy must be submitted in writing to the seller for reconsideration. Claim must be submitted within 60 days of the seller's determination. The seller will promptly provide a written explanation of the decision on your request. Requesting reconsideration is a prerequisite to any other action in order to dispute the seller's determination, including the filing of a civil suit. Any legal action regarding this limited warranty must be brought against the breeder in a court where the breeder is located.
